Disability Rights Network of Pennsylvania Files Complaint on Behalf of Trevor Schaid
On May 6, 2013, DRN filed a complaint in the U.S. District Court for the Middle District of PA against DPW Acting Secretary Beverly Mackereth claiming that DPW’s failure to allow Trevor Schaid to apply for PA Medical Assistance and the Attendant Care Waiver violates his fundamental constitutional right to interstate travel.
Mr. Schaid is a man with muscular dystrophy who currently lives in Wisconsin, but he wants to move to Pennsylvania to live near friends and attend graduate school. Since he needs attendant care services to care for himself, to transfer to bed, and for sleep positioning, he needs to have those services arranged in Pennsylvania before he can move here. However, DPW has refused to allow him to apply for Medical Assistance and the Attendant Care Waiver in advance of his establishing Pennsylvania residency. These policies and practices prevent Mr. Schaid from moving to Pennsylvania, which is a violation of his constitutional rights.
