Disabled Access Credit Expansion Act of 2021

The Disabled Access Credit Expansion Act was reintroduced by Senator Tammy Duckworth (D-IL) and Representative Donald McEachin (D-VA-4) and does several things.

The legislation would make it easier for businesses to comply with the Americans with Disabilities Act. It does so by increasing the size of the current tax credit to help pay for accessibility for employees and customers. The tax credit would increase to $20,500, up from the current limit of $10,250, and be adjusted annually for inflation.

The legislation would expand the number of small businesses eligible for the credit. Eligibility would extend to small businesses with gross receipts of $2.5 million dollars or less, up from the current limit of $1,000,000.

The legislation would also expand the types of access allowed under the law to include any digital, Internet or telecommunication services provided by the business. This is in recognition of the trend to permit remote work and services for many employees and businesses.

The Disabled Access Credit Expansion Act would also provide increased funding for the U.S. Department of Justice to facilitate voluntary mediation to resolve disputes under the Americans with Disabilities Act. Currently, Congress does not directly appropriate funds for the ADA Medication Program. Money under this act would help hire or contract with personnel to carry out the program and provide training for mediators.

The legislation would also require the U.S. Attorney General to provide data on the types of calls that come into the toll-free ADA Information Line.
