Disability Rights Pennsylvania Represents Veteran to Have 100 PAS Hours Restored

In March of 2025, a Pennsylvania veteran contacted DRP after losing his CHC MCO grievance hearing which resulted in his Personal Assistance Services (PAS) hours being reduced from 100 hours to 44 hours per week. The veteran felt that his MCO had incorrectly conducted his needs assessment and failed to account for his acute fall risk due to his disabilities and medication. The reduction in PAS hours resulted in the veteran’s PAS worker advising him that he wanted to leave.

A DRP staff attorney stepped in, entering her appearance to represent the veteran at a Fair Hearing appeal. In August, the parties agreed to withdraw the appeal and settle the matter by immediately restoring the veteran’s 100 PAS hours (despite his missing the appeal deadline) and to conduct an additional assessment and review his records from the VA.
