DRP Assist Students with Occupational Therapy and Specialized Needs
In 2023, Andrew Favini and DRP filed a Due Process Complaint on behalf of a minor child and against his school district for the school district’s failure to provide FAPE when offering only segregated placement options and for forcing parents to pay for the child’s Personal Care Assistance services out of pocket. The school district also failed to correctly determine the child’s needs for Occupational Therapy services during school breaks. Parents and the school district reached a settlement agreement in which the school district agreed to reimburse parents for money previously spent on tuition and Personal Care Assistance and to reimburse the same costs going forward. In addition, the school district agreed to pay for the student’s occupational and physical therapies, specialized instruction, speech and language therapies, and attorney’s fees.
