DRP Assisted Individual Who Was Unlawfully Required to Submit Medical Evaluation Form in the Pre-Offer Stage of the Hiring Process
Disability Rights Pennsylvania assisted an individual with disabilities who had applied for a job with the LEAP Program through the Free Library of Philadelphia. During the application process, before an offer of employment was made, the individual was told she was required to have her physician complete a medical examination form, disclosing her disabilities. DRP contacted the City of Philadelphia’s legal department and explained that the Americans with Disabilities Act, which prohibits discrimination against individuals with disabilities in connection with job application procedures and hiring, prohibits the City of Philadelphia from conducting medical examinations or making inquiries of a job applicant as to whether he or she is an individual with a disability at the pre-offer stage.
Thereafter, individual was not required to complete the medical evaluation form during the pre-offer stage of the hiring process. Ultimately, the individual successfully completed the hiring process and was offered a job.
